PRIVACY POLICY FOR BOSE SOUNDTOUCH PRODUCTS
INTRODUCTION AND PRIVACY HIGHLIGHTS

Bose Corporation is committed to respecting your privacy. Ensuring you understand what personal and other information Bose collects about you, how we use and share this information, and the steps you may take to limit this use or sharing, is fundamental to our respect for our customers. Please read this privacy policy, which describes how we collect, use, and share information in connection with our SoundTouch (TM) systems, as well as the SoundTouch computer software and mobile applications (collectively, "software")

As detailed in this privacy policy, your personal and other information will be controlled and processed by Bose Corporation, a U.S. company whose principal office is located at The Mountain, Framingham, Massachusetts, 01701.

Bose collects certain information about you through the SoundTouch system and software in order to enable the proper operation and servicing of your SoundTouch system. We also use this information to support your relationship with Bose, to manage our business, and for certain other purposes as described below.

By selecting the check box or button and proceeding with the set-up of your SoundTouch system and software, you are consenting to the collection, use, and sharing of your personal and other information as explained in this privacy policy. If you do not consent to the terms of this policy, do not continue with the set-up of your SoundTouch system, and please contact Bose.

As discussed in more detail below, we collect a variety of technical information when you use your SoundTouch system and software, including your system’s IP address and system ID. We also collect usage and content information, such as the content stored on your SoundTouch system presets and your SoundTouch listening history (including recently played stations, playlists, artists, albums, songs, or podcasts).

We also use your IP address to derive information about your location when you use your SoundTouch system. We analyze this information each time you use the system to ensure that you have access to the appropriate content for your location. Importantly, however, we do not store your location information or track your location over time.

We may combine any information that we collect with personal and other information that we receive from other sources, both online and offline. This information may be transferred to and stored in Bose databases (including cloud databases) located in the United States or elsewhere, or may be shared with Bose subsidiaries, authorized distributors and resellers of Bose products, trusted third-party service providers that act on our behalf, or music-streaming services or other content providers located throughout the world.

With your consent, we, a Bose subsidiary, or an authorized distributor of Bose products also may use (or share with a trusted service provider) your personal information to send you marketing messages about Bose or related third-party products or services that might be of interest to you. You will be given an opportunity to express your consent or refusal when you set up your SoundTouch account.

 

As discussed below, you may set up and configure your SoundTouch system pseudo-anonymously, but you will not receive important information about product updates and other communications from Bose. Further, we will continue to collect certain information (including system IP address and preset information) that is needed for the proper operation of your system, though we will not be able to link that information to you personally.

 

You may have a right under applicable data protection law to access, amend, and/or request deletion of information that we collect about you. You may withdraw your consent to certain data processing by contacting us at the appropriate number provided at contact us, or by sending us an email at privacyandsecurity@bose.com.

This privacy policy is specific to information collected through the SoundTouch systems and software; different privacy policies apply to other Bose Corporation customer operations and can be viewed at http://global.bose.com. As used within the context of this policy, "personal information" means personally identifiable information such as your name or email address.

PERSONAL INFORMATION AND OTHER INFORMATION WE COLLECT

The primary purpose of collecting this information is to enable proper operation and servicing of your system (see "How we use personal and other information" below). You agree that we may receive and record a variety of information about you through the SoundTouch (TM) software installed on your computer, tablet, or mobile device. You also agree that we may collect information through the SoundTouch system.

The information we may collect includes both personal information and other information, such as:

Technical information, including:
· Internet connection type and speed
· List of SoundTouch systems and software applications
· SoundTouch product firmware version(s), MAC address(es), IP address(es), and Wi-Fi(R) signal strength
· SoundTouch software version(s
· Location information derived from your IP address (this information is analyzed each time the SoundTouch system is used, to enable access to content that varies depending on a user’s location, but this information is not stored or tracked over time)
· Operating system and/or device type for the computer, tablet, or mobile device used for the SoundTouch software
· Email preferences
· Password for the SoundTouch software (this information is altered by "hashing" and thus cannot be accessed in its original form by anyone, including Bose)

Content and usage information, including:
· Content stored on the SoundTouch system presets
· SoundTouch system listening history and content data, including recently played stations, playlists, artists, albums, songs, or podcasts
· SoundTouch system and software use and content patterns (including the duration and timing of system use and content streaming)
· Service "tokens" containing authentication information that enables seamless delivery of third-party content to the SoundTouch system
· Transactional information enabling digital rights management

You agree that this information will be collected and stored in one or more Bose databases (including cloud databases) and databases of select third-party service providers acting on our behalf. These databases may be located in the United States or elsewhere outside your country of residence.

You may set up and configure your SoundTouch system pseudo-anonymously by providing a single-purpose or even non-working email address and by electing not to provide your real name, address, or other personal information during the sign-up process. Please note, however, that you will not receive important information about product updates if you do not provide a working email address. Further, the automatically-collected information listed above (including IP address and listening history) will continue to be collected and associated with your account, as these are needed for proper operation and servicing of your system, but Bose will not be able to link that information to you.

During the set-up process for your SoundTouch system, you downloaded software from a Bose website or from a third-party app store. The Bose website uses online tracking mechanisms, including cookies. The collection, use, and sharing of information from that and other Bose websites are governed by our online privacy policies, as discussed below. For more information concerning the Bose download site, please click on the "Privacy Policy" link at http://www.bose.com/soundtouch_app. If you downloaded the SoundTouch software from a third-party app store, you should review that party’s privacy policy to understand its practices concerning the collection, use, and sharing of your information. If you operate a music or other content-streaming service through your SoundTouch system, you should review that service’s privacy policy as well.

HOW WE MAY COMBINE PERSONAL AND OTHER INFORMATION

You consent that, for the purposes discussed in this policy, we may combine the personal and other information that we collect through your SoundTouch (TM) system and software with information that we receive from other sources, both online and offline. For example, we may combine SoundTouch information with information we collect on our website or from your phone or email communications with us.

More specifically, we may obtain personal or other information about you through sources such as:

Your communications and dealings with us (including on our websites, in stores, at special events, over the phone, and by mail or email)

Website tracking applications (for details, see the Bose online privacy policies, available at http://global.bose.com)

Our subsidiaries, authorized distributors and resellers of Bose products, and other third parties

Forms and requests you submit to us

You agree that the personal and other information that we collect and combine with SoundTouch information may include:

As discussed above, the collection, use, and sharing of personal and other information acquired through means other than the SoundTouch system and software are subject to other Bose privacy policies (and to the privacy choices that you make in connection with those policies). HOW WE USE PERSONAL AND OTHER INFORMATION

Our primary purpose for collecting personal and other information through the SoundTouch (TM) system and software is to enable the proper operation and servicing of your SoundTouch system. We also use this information to support your relationship with Bose and to manage our business. You agree that we may use your information for these purposes, including:

To enable the proper operation and servicing of your SoundTouch system

To provide a service you have requested, including services provided through or in conjunction with the SoundTouch system (such as audio streaming services)

To complete a purchase or other transaction that you initiate

To respond to your request for information and provide you with more effective and efficient customer service

To provide you with important product updates, usage tips, and other information about your SoundTouch product and content available through it

To help us make improvements to our products, services, or websites

For analysis, marketing research, or reports

To ensure adequate security or address technical issues

To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims

For other purposes with your consent or as permitted or required by applicable law (see, for example, "Marketing and privacy choices" below)

WHY AND HOW WE SHARE PERSONAL AND OTHER INFORMATION

You agree that Bose may share your personal and other information with third parties as follows:

With Bose subsidiaries, authorized distributors and resellers of Bose products, and trusted third-party service providers who assist us in providing you with efficient and effective customer service

With music-streaming services and other content providers to enable delivery of content through the SoundTouch (TM) system

With Bose subsidiaries, authorized distributors and resellers of Bose products, and trusted third-party service providers acting on our behalf to assist in completing a purchase, service, or transaction that you initiate

With trusted service providers who assist us in managing our business and who store, secure, manage, and analyze the data on our behalf

To inform current and prospective business partners about the use of the SoundTouch system and the services made available through the system, but information will be shared only in the form of aggregated data or in a de-identified manner that does not reveal personal information

To respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims

When we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, security vulnerabilities, situations involving potential threats to the physical safety of any person, or violations of our terms and conditions

We will not share your personal information for marketing purposes without your consent, as discussed below.

MARKETING AND PRIVACY CHOICES

You have choices about our use and sharing of your personal information for marketing purposes. Bose will not use your personal information to contact you for marketing purposes without your consent. You will be given an opportunity to express your marketing choices when you set up your SoundTouch (TM) account. If you consent to receiving marketing messages from Bose, you agree that:

We, Bose subsidiaries, and authorized distributors of Bose products may use your personal information to contact you by email or postal mail regarding products, services, promotions, special events, or other subjects that might appeal to your interests.

We, Bose subsidiaries, and authorized distributors of Bose products may use your personal information to target and customize the advertising and content you receive, including newsletters and promotional communications about Bose or third-party products or services. We try to ensure that this content is helpful and/or interesting to you; for example, we might send you an email or brochure about a new SoundTouch product.

We may share your personal information with trusted service providers that act on our behalf to assist us in our marketing, such as the administration of Bose’s promotional email program and online advertising.

We will not share personal information collected through the SoundTouch system or software with other third parties or resellers of Bose products for their own use in marketing products or services to you.

To consent to the use and sharing of your personal information for such purposes, please ensure that the box is checked during SoundTouch account setup. If you decide later that you prefer not to receive such marketing messages, you can instruct us to stop using or sharing your personal information for that purpose by calling Bose at one of the numbers listed at contact us.

You may also have the opportunity to express your privacy preferences when submitting certain information to us, such as during a transaction or on an event registration form. In addition, our marketing emails always include a method for you to unsubscribe from such messages.

Please note that, regardless of your request, we may still use and share certain information as permitted or required by applicable law. For example, you may not opt out of certain operational emails. To avoid this, you may set up your SoundTouch system pseudo-anonymously as described above.

SECURITY

Bose takes appropriate technical and organizational measures to protect your personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorized disclosure or access, in particular where the processing involves the transmission of data over a network, and against other unlawful forms of processing.

SPECIAL NOTE FOR CUSTOMERS OUTSIDE THE UNITED STATES

The personal and other information discussed in this policy is collected and controlled by Bose Corporation in the United States. Bose’s principal office is located at The Mountain, Framingham, Massachusetts, 01701. You agree that your information will be processed in the United States for the purposes described herein. As described above, Bose also may subcontract the processing of your data to, or otherwise share your data with, Bose subsidiaries, authorized distributors and resellers of Bose products, trusted service providers, and trusted business partners in the United States or countries other than your country of residence. Reasonable contractual or other measures will be taken to protect your privacy and ensure compliance with this policy, but the data-protection laws in these countries may be different from, and less stringent than, those in your country of residence. You expressly consent to such transfer and processing.

ADDITIONAL INFORMATION

For consumers in the United States, this policy is governed by Massachusetts law notwithstanding any principles of conflicts of law.

Changes to this privacy policy will be communicated through the SoundTouch (TM) software. Where required by law, we will notify you through other means and/or seek your consent to the changes.

2. Technical and Usage Information

We or our service providers automatically collect certain technical and usage information from your SoundTouch system; SoundTouch software and/or mobile app; and the mobile phone, tablet, computer, or other device that you use to access the Services, in order to operate and improve the Services and the user experience over time. This data consists of:

Technical information, including:

• Internet connection type, IP address, and Wi-Fi(R) signal strength
• List of SoundTouch systems and software applications, SoundTouch product firmware and software versions, serial number, and system ID
• Operating system and/or hardware model information, as well as MAC address, IP address, SSID, and other device identifiers associated with the computer, tablet, or mobile device used in connection with the SoundTouch software
• Network information such as network type and carrier
• General location information (city/state) derived from your IP address. This information is analyzed each time the Services are used, to enable access to content that varies depending on a user’s location (e.g., to provide local radio stations), but we do not collect or store your precise GPS location
• Log files and error logs

Usage information, including:

• Content stored on the SoundTouch system presets
• SoundTouch system listening history and content data, including recently played stations, playlists, artists, albums, songs, or podcasts
• SoundTouch system and software use and content patterns (including the duration and timing of system use and content streaming, button presses, etc.)
• Service “tokens” containing authentication information that enables seamless delivery of third-party content to the SoundTouch system (e.g., to seamlessly connect you to your Spotify account next time you use the Services)
• Transactional information enabling digital rights management (e.g., for music content providers to give appropriate monetary credit to artists depending on how often their content is played)
To gather the information discussed in this section, we or our service providers may use web logs or applications that recognize that you’re using the Services and gather information about your use of the Services, including software developer kits (“SDKs”), pixels, scripts, or other tracking mechanisms.

3. Information We Collect From Third-Party Services and Platforms

If you connect with a third-party service or platform (e.g., Spotify, Pandora, or TuneIn) through the Services, such third parties may allow us and our service providers to have access to and store additional information about your interaction with those services and platforms as it relates to use of the Services. If you do not wish to have this information shared, do not initiate these connections.
If you choose to interact with or use these features, you may also disclose your information directly to such third parties. Because these third-party services are not operated by Bose, Bose is not responsible for the content or practices of those services. The collection, use, and disclosure of your information will be subject to the privacy policies of the third party services, and not this Policy.

4. Information We Collect from Affiliates and Non-Affiliated Third Parties

Bose may receive additional information about you, such as demographic information or purchase history, from affiliates under common ownership and control, and from third parties, such as business partners, marketers, researchers, and analysts that we may use to supplement the information that we collect directly from you.

HOW WE USE YOUR INFORMATION

We collect information to enable the proper operation and servicing of your SoundTouch system and to help our customers get the most out of their Bose products and services. For example, we use your information to:

• Complete a purchase or other transaction that you initiate
• Provide a service you have requested, including services provided through or in conjunction with the SoundTouch system (such as audio streaming services)
• Understand and resolve app crashes and other issues being reported
• Improve the Services and enhance users’ experiences with the Services
• Test and create new products, features, and services and improve our existing products, features, and services
• Respond to your requests for information and provide you with more effective and efficient customer service
• Provide you with important product updates, usage tips, and other information about the Services and content available through the services
• Engage in analysis, marketing, research, or reports
• Provide security and monitoring and address technical issues and bugs
• With your consent, contact you by email, postal mail, or phone regarding products, services, promotions, special events, research studies, and other subjects that we think may be of interest to you

Combined Information. You consent that, for the purposes discussed in this Policy, we may combine the information that we collect through the Services with information that we receive from other sources, both online and offline, and use such combined information in accordance with this Policy.

Aggregate/De-Identified Data. We may aggregate and/or de-identify information collected through the Services. We may use de-identified and/or aggregated data for any purpose, including without limitation for research and marketing purposes, and may also share such data with any third parties, including advertisers, promotional partners, potential business partners, sponsors, event promoters, and/or others.

HOW WE SHARE YOUR INFORMATION

Bose will share your information in the following ways:

Affiliates and Subsidiaries. We may share information we collect within the Bose family of companies.

Service Providers or Authorized Resellers. We may provide access to or share your information with select service providers who perform services on our behalf. These service providers provide a variety of services to us, including without limitation billing, sales, marketing, provision of content and features, advertising, analytics, research, customer service, shipping and fulfillment, data storage, security, fraud prevention, payment processing, and legal services. Such parties currently include crash and bug analytics providers like Crashlytics, and service providers like Segment that enable us to connect your Bose Products to your Device and provide us with analytics for our internal purposes.

Music Streaming Services. When you initiate a connection with a third-party streaming service through the Services, we will share information about you that is required to enable delivery of the third-party content through the Services (e.g., your streaming service log-in credentials).

Protection of Bose and Others. By using the Services, you acknowledge, consent and agree that we may access, preserve and disclose your information, including, but not limited to, any user content, if required to do so by law or in a good faith belief that such access, preservation or disclosure is reasonably necessary to: (a) comply with legal process (e.g., a subpoena or court order); (b) enforce our Terms of Service, this Policy, or other contracts with you, including investigation of potential violations thereof; (c) respond to claims that any content violates the rights of third parties; (d) respond to your requests for customer service; and/or (e) protect the rights, property or personal safety of Bose, its agents and affiliates, its users and/or the public. This includes exchanging information with law enforcement and with other companies and organizations for fraud protection, and spam/malware prevention, and similar purposes.

Business Transfers. As we continue to develop our business, we may buy, merge or partner with other companies. In such transactions, (including in contemplation of such transactions, e.g., during due diligence) user information may be among the transferred assets. If a portion or all of Bose’s assets are sold or transferred to a third-party, customer information (including your email address) would likely be one of the transferred business assets.

Consent. We may also disclose your information to third parties with your consent to do so.

Aggregated and Anonymized Information. From time to time, Bose may share aggregated and/or anonymized information about use of the Services, such as by publishing a report on usage trends. This Policy places no limitations on our use or sharing of such aggregated and/or anonymized information.

MARKETING CHOICES

With your consent, we, a Bose subsidiary, or an authorized distributor of Bose products also may use (or share with a trusted service provider) your information to send you marketing messages via email or postal mail about Bose or related third-party products, services, promotions, special events, newsletters, or other content that might be of interest to you. You will be given an opportunity to express your consent or refusal when you set up your SoundTouch account.
If you decide later that you prefer not to receive such marketing messages, you can instruct us to stop sending such communications by using the “unsubscribe” link in our email marketing messages or by contacting us at the numbers provided below. Please note that, regardless of your request, we may still use and share certain information as permitted or required by applicable law. For example, you may not opt out of certain operational emails.

CHILDREN’S PRIVACY

The Services are not directed to children under the age of 13, and Bose does not knowingly collect any information from anyone under the age of 13. We recommend that persons over 13 but under 18 years of age ask their parents for permission before using the Services or sending any information about themselves to anyone over the Internet.

INTERNATIONAL USERS

The information that we collect through the Services may be transferred to our headquarters in the United States and processed for the purposes described in this Policy. Bose also may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence. The data protection laws in these countries may be different from, and less stringent than, those in your country of residence. By clicking the check box or button “I agree” and proceeding with the set-up of the Services, you expressly consent to such transfer and processing.

YOUR RIGHTS

If you want to learn more about the information collected through the Services, or if you would like to access or rectify your information and/or request deletion of information we collect about you, please contact us using the contact information below. You may also object, based on the legitimate grounds, to the processing of your information.
You may also provide us with instructions regarding the manner in which we may continue to store, erase and share your information after your death, and where applicable, the person you have designated to exercise these rights after your death.

CHANGES TO OUR PRIVACY POLICY

We reserve the right to amend this Policy at any time to reflect changes in the law, our data collection and use practices, the features of our Services, or advances in technology. We will make the revised Policy accessible through the Services, so you should review the Policy periodically. If we make a material change to the Policy, you will be provided with appropriate notice and we will seek your consent to the updated Policy in accordance with legal requirements.

HOW WE PROTECT YOUR INFORMATION

Bose takes steps to protect user data against loss or unauthorized access, use, modification, or deletion. However, no security program is foolproof, and thus we cannot guarantee the absolute security of your information.

CALIFORNIA PRIVACY RIGHTS

California law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined by applicable California law) with third parties for their direct marketing purposes. If you have a question related to this right, you can contact us at the information provided below. However, we do not share such personal information collected through the Services with third parties or resellers of Bose products for their own use in marketing products or services to you.
Please also note that the Services do not recognize or respond to browser-initiated Do Not Track signals or similar mechanisms, as the Internet industry is currently still working on Do Not Track standards, implementations, and solutions.

HOW LONG WE STORE YOUR INFORMATION

We will retain your information for the period necessary to fulfill the purposes outlined in this Policy unless a longer retention period is required or permitted by law.
